I am having basic legal query regarding discharge under CrPC section 239/227. As of now only FIR is lodged against accused under IPC 498a and other sections. It’s being more than eight months now after filing FIR and Charge sheet is not submitted as of now. It seems that Police is intentionally delaying process as per instructions from complainant as they are waiting for outside court settlement which I am not going to do.
So I want to check if it is legally possible to file discharge when Charge Sheet is not submitted and to get discharge from allegations mentioned in FIR?
