Direct FIR u/s 495 PPC by SHO

Helo All .
Can a SHO file FIR u/s 495 against Accused/Husband , on an application of 1st wife against remarriage of her husband.

Section 495 Crpc is applicable only for the second wife or subsequent wife. If the FIR has been registered and section 495 Crpc is levelled, you can contest it from the point of legal merit and get acquittal order. But ensure that the second wife is not produced as witness!
