Delayed possession of flat purchased

Hello all,

I had purchased a flat directly from a reputed builder in thane, maharashtra. The registered agreement took place between me and the builder in the year dec 2010. The date of possession of this flat as per the registered agreement is may 2012 but till date the builder has not handed over the possession to me.

He sent a letter to all the flat owners saying that the possession is delayed due to unavailability of construction material, labor and delay in approvals from local govt and municipality. Vide this letter he gave a exit clause to the flat owners that he will return the invested amount + interest of 9% p.a or he will give the possession of the flat by dec 2013. I opted to wait.

But the builder has still not handed over the possession to any of the flat owner.

Now i would like to know my legal options. Can i put a case on the builder and seek for monetory compensation from the builder?

you can immidiately suit file against him
