In the matter referred to me by my client 1] Inspecting official has made application for delay condonation for filing chargesheet to magistrate. Magistrate has sanctioned this.Now Question is Whether is it binding on Magistrate to issue Notice to Defending parties and Accuse and other parties? 2] If Notice is not issued,can the delay condonation made by Magistrate amounts to BAD in Law,Illegal ? 3] Can the accuse Prefer application for dismissal of case?
