delay in case diary

Police has not submitted case diary in a case under IPC 376, since one month after moving a Anticipatory bail U/s 438 Crpc, in district Session Judge

kindly advice me what step i shoud take in this regard,

and how long the accused will suffer from such delay as the accused cant come out freely due to fear of arrest.
