Defamation and wrong reference

Hi, My brother was working for a company which is one of the top private sector bank. This was his first job. He work there for 1.6 years but in between there were many problems with her manager he' just escalate one thing which was going wrong against her. So the bank terminated him without any reason and close down his systems and said you are terminated. But they didn't give the reasons. So we tried a lot and then they said you resign we will give reliving letter and terminated tag will be not shown. But after since three years from that my brother has been selected in other company but after giving offer letter they reject it . and don't take him When we asked why they don't give any answer. So we have come to know that it is just because of the previous employer. They are showing him terminated but my brother is showing that he had resigned but this was only given just for our sake. So wat should we do should we ask the company for the terminated reason. Because they have just given N reliving letter without serving any notice period. But shown terminated or absconded there. And we are very confused with to do v because they have ruin his career and he his not getting job because we are not understanding after selection in various companies why they removing him after some days. Please help. He is been very depressed and getting under stress.

You have left lot of gaps in your story.

For instance, you say: "So we tried a lot and then they said you resign we will give reliving letter and terminated tag will be not shown. But after since three years ..."

You have left the gap by not stating (i) whether your brother gave resignation letter and (ii) upon such resignation letter, whether the bank gave a Relieving letter to your brother or not?

Sir they terminated him but we told and put the pressure on them by telling how can you spoil the career so they told o give resign then he resign and some of the officer sign it we have the copy now also and they instantly give an reliving letter of without notice period. So we take that. but since three years many of the company have told the format is not proper so they have given 4 to 5 reliving letter . during this period . but after selecting in various companies and issuing him a offer letter they are rejecting him after some days. We have come to know that they have put him absconded in their system or terminated but just they have gave reliving letter in the name sake. So my brother was telling everyone I had resigned but they have not changed they are still showing terminated or absconded. And saying we have given relieving just for the name sake So wat to do should we case file against them because they are not giving terminated reason and they have not given chance to serve any notice period. So they are playing game with him and not proving the correct picture and does they have is put him in a black list. To take revenge. We are not understanding . so please help

We have offer letter of various companies with us but for some reason they are rejecting him after only some days. When we asked for the reason they don't give

Pls ask the employee that was working with top bank to draft the query in chronological order so that proper understanding is possible ….

As you say that the Company has given acknowledgement on your brother's resignation letter and also given your brother a relieving letter, the question of absconding does not arise.  Therefore, meet a lawyer in your area, show the documents, and request him to serve a legal notice on the company asking it to correct the records  to show on the website or whatever  the correct position of having relieved your brother and not to show any 'absconding' etc.  Also ask for confirmation that they have so corrected.

If you do not get any positive response and action from them, then file appropriate Suit before a Court of law to compel them to correct their records.

The main thing what I have noticed in your letter is that, what you have done all those three years and you should have given more details what has happened in those three years. Mr.Chirag,

First of all please clear that your brother was onroll or offroll staff and what exclaration he has done against his boss and what was the evidence and mode of it.Secondly no one can terminate any staff without giving SCN or intimation because inquirey happens first.Still if such thing has happened then mark a proper mail to higher management along with evidence.

Secondaly,you are saying that you brother is getting offer letter from other company,but want to clear that offer letter is issued only after verification then he should join.
