Deemed conveyance

Society had filed & got an order in their favour under Deemed Conveyance (Mumbai). Due to disputes with the occupants/tenants in the same property, the Society did not pay the Stamp Duty as per the order passed. Society now wants to file another Application under the same Deemed Conveyance Act claiming only their proportionate area and are ready to forgo the area occupied by the tenants.

Is it possible under the Act?

It may not be possible to do so now. The order is final and if the conveyance deed submitted is executed society has not only to pay stamp duty but also accruing penalty at the rate of 2% per month and further the society cannot file another suit on the same cause of action.

Deed is not yet executed. So where do we stand now?
