Death of employee due to cheating by an mnc

A MNC lies to a young Indian  ( highly skilled and highly paid ) employee about precautions taken by it about health and safety in World"s Highest  deadly P.falciparum malaria pandemic Country Nigeria in written  and transfers the employee in that country.The  employee gets posted there for a duration of about 45 days,  catches the deadly  P.falciparum malaria( Almost all Malaria deaths are caused by  P.Falciparum Malaria)   returns to India ,gets Sick ,goes on ventilator and painfully dies after  27 days of return  to India.The fact that employee was ill after return from Nigeria and has caught P. Falciparum malaria has been mentioned in his Death Summary. Under what Sections the company can be framed?The case is about 10 years old but all facts have recently been discovered.Thanks

Since it's an employment wherein you have agreed to follow the terms and conditions as per your employment letter, I don't see any remedy here. When they transferred the employee to Nigeria, he could have refused. However, there might be a term in the employment letter which would talk about the working conditions which the company would provide. If any of the working conditions in Nigeria are contrary to the ones mentioned in the employment letter then yes, we do have a case. 10 years is a long time, how come the facts came to your knowledge now.
