My parents inherited some land from my mother's parents and post my marriage "gifted" it to me and my husband. I have 2 brothers also and they were not given any share in this property. Instead my parents gave (promised to give at that time) my father's self earned property to both sons.
Due to heavy debt brought by eldest brother, we sold off of the part of the gifted property and in turn received a portion from the self earned property which was given to my eldest brother. Though this small chuck was "bought" as sale deed from my father by us (was still in his name at that time). And gave the remaining property to both sons (gift to elder and sale deed to younger) . There is no document proving that the ancestral property was sold and money was given to my eldest brother. All dealings were through my father.
Now, my eldest brother has filed for separation from his wife.
1. What right will his wife have on this ancestral property?.
2. We have sold part of the ancestral property for our own use, would there be any compensation claim over that?
3. What will be her right on my brother's property (gifted by my father)?
4. Will she have claim on the remaining property of my father's self earned property? (my share and my other brother's share)?
