Datawind product not delivered

dear experts

I had ordered a tablet (Ubislate7) from Datawind computers in April 2012 and my cheque of rs 2999 has already been debited bythe company. despite a number of emails and phone calls i am yet to receive the  item. the standard reply is as below

We understand that the device deliveries got delayed due to certain unforeseen reasons. We regret the inconvenience caused due to delay. Your order is in process. You will get your device soon. Kindly bear with us for some more time.

in the meantime i was advised to upgrade the order to Ubislate 7ci with additional cost, to which i had agreed, but i still have not got the order. please advise me on how to go ahead.

They might not have avilable the item, for which order has been placed by you. Since you have the proof, you can move to consumer forum.

Issue legal notice to them, if no response, file consumer case as advised by MS..Khan. You can also collect damages, legal expenses etc.
