Crpc 125

Dear Experts,

Divorced wife files a Petition under Crpc 125 and akked Rs 40000 pm as maintenance and Rs 20000 pm as Interim maintenance.

The circumstances are as follows

!. Divorced wife continue to reside in matrimonial home using all amenities

2. Highly qualified and working lady with no children

3 Husband resides in rented house

Please guide and help with some judgments to reject the maintenance prayer..

1) After divorce wife can stay where she want.

2) Maintenance is not given to her. Since she is highly qualified she can get job and handsome money which is sufficient to maintain her. Plz find judgement where no maintenence is given to wife in Delhi.

Did you meant to say that even after divorce she continues to live in matrimonial home.in that case if she is not the joint owner of the property then she has no right s to stay in the ex husband's home.you can evict her only through the due process of law.file a eviction suit against her to evict her from home.
