Sir,

Whether an accused person is a criminal ?

There is no direct presumtion under evidence Act, However you may like SC judgements : Babu Ram V state of Keral 2010 SCC and Surjit Viswas V Sate of Asaam (2013) SC.

Thats why he is called 'accused' that means there are charges against him which are to be proved in court.
