Court juridiction

Hello Learned members

Husband and wife lived together in Gurgaon and because of some misunderstnanding wife left husband and went to hometown in Kerala. Husband moved to Noida coz of profiessional reason. Now husband wants to file for divorce.

Question: Can he file divorce in Noida? or he has to file in Gurgaon.

NB: Husband has got current valid rent agreement in Noida only.

Caution: If you file divorce case, she will definately file 498a and DV act in kerala and you have to go there to attend court hearing. So better to convince her for mutual divorce.

MCD is best option.

Since you are contemplating due to some misunderstandings, try counselling,intervention by elders and remove the misunderstandings and save the marriage.

You can file divorce at place of last residing together or at the place where you are staying currently.  Even she can also do the same at her current place of residence.

You need not worry that your wife will file some cases on you.  Once the matter is in court, police wont take any complaint against you.  They will ask your wife if at all she approaches PS, to go to court with her greivances regarding dowry or manhandlind if so any.

Now its up to you whether to file divorce or not.  In any case you consult a good Advocate locally who handles matrimonial disputes and criminal cases.

You need one photo of marriage and wedding card + aadhar card to file divorce petition.
