Court fee stamp for n.i.act section 138 case

I have one querry as regards the stamp duty for 138 case. The cheque amount of Rs 5,11,400/- so the how much court fee required to file case at court.

Pls guide me.

Quick Summary
This discussion clarifies the court fees required for filing a case under Section 138 of the Negotiable Instruments Act. It explains that stamp duty is a state subject and often not applicable to these criminal complaints, with nominal fees in some regions. However, the exact amount can vary significantly by state, so consulting local court registries or lawyers is recommended for accurate information.

Stamp duty is a State subject, which differs from a State to another.

A complaint case under section 138 of Negotiable Act, 1881 is treated as "Criminal" complaint which do not attract Stamp Duty. It is Rs. 2/- (Two only) in Delhi and Rs. 10/- in Punjab, Haryana and Uttar Pradesh.

However, it would be better to check with the  registry of the Court / local lawyer / any court clerk.

It is a state subject and in Tamilnadu it is 5% of the cheque amount.
