Situation: Suit was filed with Written statements from defendant as well, trial completed and decreed in favor of plaintiff. Defendant filed appeal and decree was setaside. Fresh trial was ordered. Process took about 5 years.
Meanwhile, plaintiff made changes to property raising a cause of action for injunction by defendant. Can Counter claim be filed in suit where fresh trial was ordered?
Question is at what stage can a counter claim be filed
