Counter case

Sir Can court accept a counter claim case of defendants against plaintiff without any evidence?

CPC ORDER 8 sec6-A and sec6-B provides for defendent for claiming counter claim and has to prove his counterclaim.so defend how counterclaim s are not maintainable by filing reply to counter claim as per sec6-E of cpc.
