Correction of dob in education records

My friend (male, 22) and his sister (female, 20) are seeking legal guidance for correction of their Date of Birth (DOB) across educational records. In 2013, both students shifted from a Marathi-medium school to an English-medium school. At the time of admission, the then principal of the English-medium school advised the parents to reduce the age and change the DOB so that both children could repeat lower classes (brother was admitted to Std. 1 instead of Std. 3; sister to Sr. KG instead of Std. 2). Acting on this advice, the mother consented to changing the DOB in school records. Their Aadhaar cards were also initially created with the incorrect DOB. In 2018, once the brother became aware of the issue, the DOB was corrected in Aadhaar based on the original birth certificates. He approached the school for correction, but by then the principal had changed. The new principal refused to modify school records and stated that correction was unnecessary and would not cause future problems. Both students continued their education and completed SSC and HSC from the Maharashtra State Board. They are now in college— • Brother: University of Mumbai (MU) • Sister: Savitribai Phule Pune University (SPPU) Currently, they are facing serious issues with ABC ID, DigiLocker, and marksheet generation due to mismatch between Aadhaar and educational records. When they again approached the school for correction, the school refused, stating that the request was delayed and denying any prior approach for correction. The Maharashtra State Board is refusing to process DOB correction unless the school admission records are corrected first, which the school has declined to do. Both students possess valid Municipal Birth Certificates showing the correct DOB and are seeking legal remedy.

In the given situation, the school authorities cannot change the date of birth in the school certificate.

Hence you may have to approach civil court with a suit for declaration to declare correct date of birth and a direction to concerned school authorities to rectify the school records and modify the school certificate with correct date of birth.

You have further optin to make a representation to the Government. But, ultimately, you may need a direction from the Court.

Expeditious remedy is in approaching the High Court of Bombay in a Writ Petition.

Can any advocate / lawyer who practices in high court help me in this situation? If so please reply to this message. I'm facing many issues because of it. I'm feeling depressed. Please help. I have no contacts to advocates or lawyers and to them I've approached haven't been of lot of help.

You may have to look for an advocate yourself, you can choose one from this forum too who hails from your place or you may approach the nearest bar association to find out a suitable advocate.

There are so many decisions from various courts that DOB cannot be chaged after S.S.C .Accordingly the Govt issued orders to the institutions and corporations not to change the DOB after 15 years of age or S.S.C.So there is no chance to change the DOB at any cost.

But sir I was a minor at that time and my parents did not knew the consequences. Thay were just following the advice of the principal. And we attempted to change the DOB when I was in 5th class but the new principal refused. Sir I'm facing various issues right now and will face many in the future. Almost every document requires aadhaar and marksheets. Please sir, help me. I have no guidance I'm on my own. My parents are not that educated, so I don't even want to blame them. They just wanted to do best they can. Is there any possibility that court will approve.

Get aadhar and other documents amended as per record, even if these are incorrect /modified by parents.

Cannot change in aadhaar because I already used the chance to correct it. Is there any possibility to change in education records because aadhaar is in accordance with birth certificate and I want changes in education records as per birth certificate. Because birth certificate is becoming more important these days.

Contact, consult and engage a local prudent lawyer with relevant records for proper anlayses, professional advise and necessary proceeding such as issuance of notice, preparation of affidavit, publication in newspapers/gazzette, filing a declaratory suit or any other acion as s/he may deem fit and proper.

1.  How many years difference in both documents, municipal birth certificate and school certificate. You want to correct in school certificate. You are in Thane Maharashtra. It can be corrected but after passing many years case become very critical to define.  You may call me on 9202369623.
