Private trust property can be purchased or not

sir 

private trust was formed by a lady and for activities to be carried the settlor had given her house as her share. later she cancelled the trust as she had become old and not abale to carry the activites of trust. in the mean time as case was pending against the property, the parties were compromised and court passed compromise decree ordered to share 50% each. one party executed will deed and registered the same and allotted the sale proceeds in the will after sale of her share in the property.

 

please give advice can i purchase the property or not

Yes you can...but don't forget to get all paper cleared and all due clear.

I will suggest you to give a notice in local paper that you are going to buy that property ,if anyone have any problem give them time to contact you..Only after that period buy that property.

1. IF Private Trust was duly registered and IF the Lady's property was duly transferred to Trust and IF such property was reflected in the Balance Sheet of Trust, THEN such property CANNOT be sold without passing proper resolution of Trustees and obtaining written permission from the Registering Authority (Charity Commissioner /or other authority).

2. IF the above was complied with, THEN by virtue of the Court Decree, the said property can be duly purchased.

Take the certified entire certified copies and contact local civil advocate and his opinion Nd afterwards you purchase.investing huge money take proper eminent advocates advice.
