My interim stay order got extended by six weeks and the order copy has the following contents.
"The notice sent by the learned counsel for the petitioners to Respondent No. 2 returned unserved. Hence, the learned counsel for the petitioners is hereby directed to take out a fresh personal notice to the second respondent by RPAD and file proof of service into the registry. Interim stay granted earlier is extended by six more weeks. Post after Pongal Vacation, 2011"
Can some one briefly explain what is meant by, "fresh personal notice to the second respondent by RPAD" ?
Actually the 498A gang is intentionally not receiving the notice. If my advocate send the same show cause notice again now, it is no use. It will again come back and it is again un served.
Recently they filed for maint u/s 125 Crpc and she attending for that in the lower court. Can I ask my advocate to serve the notice via lower court ? Or Shall I take the notice and serve her in the court?
