Constitution

A reputed Christian organisation in tamilnadu wants to build a church in the place allotted to Christian's to construct a church at tamilnadu housing board site area. Similarly separate places were allotted to Muslims & Hindus also where they have constructed mosque and temples in their respective places. Now some residents are opposing the construction of church citing noise pollution and other disturbances .

whats the remedy for this Christian organisation...?

Since the Tamil Nadu Housing Board (TNHB) explicitly earmarked and allotted the site as a "religious purpose plot" alongside the plots for the mosque and temple, the organization holds a strong legal foundation. However, public opposition on grounds like noise pollution can stall local body construction approvals or lead to civil injunctions if not systematically addressed. Under the Tamil Nadu Combined Development and Building Rules, constructing any religious structure requires a strict approval process.

If the local administration delays building approval or refuses to provide police protection out of fear of local friction despite the organization holding clear title and approvals:

Move the Madras High Court for a Writ of Mandamus directing the local body to sanction the building plan and ordering the District Collector/Superintendent of Police to provide necessary protection for construction.

If local residents actively trespass or physically block construction, file a civil suit for a Permanent Injunction against the interfering individuals to legally bar them from halting work on land that belongs to the organization.

Filing of a Writ of mandamus before Madras High Court is the best option.

If the prosed construction is duly approved by the authories concerned, the protests are of no consequence.
