SHARAD CHANDRA DANEJ (Asstt. Manager)     02 May 2016

Consent of joint owners

A flat in a CHS in Mumbai is in the name ofA, B and C. A and C are husband wife (divorced). A and B are brothers. Now A gifts his share in the property (1/3rd) to B his elder brother. My question is : whether consent of C divorced wife of A, is necessary?

But sec 44 of Transfer of Property Act 1882 says consent of other co-owners should be obtained.
