Complaints and final report

1. Police submitted final report in the FIR.

2. Complainant files protest application

3. Magistrate accepts final report submitted by Police and rejects the protest application.

 

Question: Can Complainant now file Criminal Private case on same grounds ? is it sustainable in eyes of law ?

You can not initiate private complaint on the same ground but you can file appeal in session court against the rejection order of protest applications. Or you can file writ in high court.
