Ans to your Qn depends on multiple factors, such as: nature of industry of your company (mfg, Estt, IT, Healthcare etc), only men employed or women also, OT standards of the company, OT hours in a month, 6-day wkg or 5-day working norm of the company, whether govered by Social/Fair Compliance Audit needs, etc. Legal application & interpretation is so diverse that an open-ended query like yours cannot be opined in certain way, unless related factors are analysed. Prima-facie, compensating in case of a national bundh is well accepted, and will not be put to legal scrutiny. In Pvt Sector, Employer cannot give paid/uncompensated holiday, and question of unwillingness does not arise, and hence enforcing authorities too will not question this action of working on another holiday as compensatory.
