Dear learned Members,
In an 138 case, conviction was sentenced by magistrate court - imprisonment + fine + compensation of cheque amount with interest. Fine was paid and sentence suspended for one month
When appeal was filed before Principal Sessions court, sentence suspended until disposal of appeal, but directed to pay part compensation (12% of entire compensation) within one month without any default clause.
Request learned members, whether insisting on depositng part of compensation is valid. Secondly, what would happen if compensation is not paid.
