Can a co op hsg soc in mumbai issue Share certificate of Flat in name of Karta and mention in certificate that "name of karta-huf -through wife". If Karta is Secretary of the society.Sale Agreement mentions only name of Karta. Share Certificate mentions Name as: Mr. XYZ HUF through (wife) Mrs. AXZ. Is this allowed?

If the property is purchased by an individual then the act of furnishing the share certificate by the society in the name of karta is invalid and illegal.

If this was purchased under HUF and if the sale deed itself is in the name of karta as well as if the application for share certificate was in the name of Karta then it can be justified and not otherwise.

There is no legal infirmity in purchase and registration of a sale deed in the name of Karta of HUF.

It is better to show relevant records to a local prudent lawyer for proper appreciation of facts, professional advise and necessary proceeding.
