Closing prosecution evidence - prosecution witness absence

Recently, the Hon'ble High Court of Kerala pronounced a ruling that, if the Prosecution Witness fails to appear on three Case Dates, the Court has the power to close Prosecution Evidence. I do not know which Judgment it is. I could not find that Judgment on Internet. Any of the advocate friends here, could you please share which Judgment it is ?

The government is  to bring a CrPC amendment Bill on 26-07-2010 , providing for imposing a limit on the number of adjournments in a case in court during trial, in the monsoon session of Parliament beginning July 26.
