Civil suit dismissed

Hello Learned Members,

I have filed a petition seeking relief under specific performance act in the district court. The respondent didn't appear in the court even after multiple hearings. The suit was dismissed saying that the Batta was not paid and no representation from my side. When I checked with my lawyer he says that he has paid the Batta expense and he is going to file a petition to reopen this suit.

Question:

1. What is the possibility to reopen this disposed suit?

2. Will the court issue notice to the respondent before they decide if this suit should be reopened or not?

3. What should be the contents of the petition to convince the court to reopen the suit.

Thank You in advance

Your query is not clear whether the suit was dismissed for non appereance of the plaintiff or the defendant, but give time to your counsel to restore the suit.

Sir the order says that the plantiff called absent and batta not paid. But My lawyer says he had paid the batta.
