Civil suit case - question

sir,

my civi suit case was dismissed due to non appearnce of my lawyer in trial. this is in a district court at pune.

is there a procedure to recontinue it after the dismissal. how esay is it to reopen it..can the defendant opposite it.?

Move application under order 9 rule 9 CPC for setting aside dismissal order on the ground there was sufficient cause for non-appearance. Yes the opposite party can oppose the application for reopening the case. Court usually allow and impose cost on the petitioner to be paid to the respondent. Kick the present lawyer and get another one.

Move application under order 9 rule 9 CPC for setting aside dismissal order, mentioned your reason for not attending the Civil Suit. Court will consider the case on merit. Opposite party may oppose you application. Hire good lawyer.
