sir, Weather Remedy available order 9 rule 13 and order 41rule 1 cp c canbe sort at time regarding same order if show what's latest position of supreme court on above said point

No,you can either file petition for setting aside ex-parte decree u/o 9 r 13 cpc or regular civil first appeal u/o 41r 1 cpc but can not file both..
