On account of help from learned members of the forum I have filed applications under section 127(2) and section 340 crpc and will be filing my reply under section 125(3) AS MY WIFE IS CLAIMING MAINTENACE FROM THE PERIOD AUGUST 2009 ONWARDS TILL JULY 2010. sHE HAS NOT CLAIMED ANY MAINTENACE FROM 1.1.2008 TILL AUGUST 2009.
The limitation clause comes into effect as my order under section 125 was effective from 3.7.2007.
I paid maintenave for 6 months out of which she collected for 3 months and did nt collected for another six months .
