first issue notice, if not reverting then it is a case of cheating

It will come under 138 NI Act and Sec. 420 IPC. Issue notice accordingly, also verify the sign on the cheque as to who signed it, Cheque owner or  accused (person who issued it).

Neither NI 138 and nor 420 will be applicable.
