cheque case

when a cheque case filed with delay condonation petition but without petition only affidavit filed, the accused after service of notice contended that this affidavit is invalid ? is it correct post your answers.

Yes, That is valid as you had elobrated facts in that  and you can move application now who is stopping you from doing that.
