sir/madam,
if complaint is filed before the court which is proprietary concern but only proprietor is made party but proprietary concern is not made as party to the complaint... my question is whether such omission will affect the merit of case? plz answer....

The cheque is from personal accourt or proprietorship account if later you should have made it a party.
Howerver it is a finer point and unless the defense advocate is sharp it is even not understood.
