Cheque bouncing

Dear sir

For a cheque bouncing case ,as per your advice ,I have sent a legal notice to the defaulter.After 15 days if the defaulter is not paying ,can I  file the case against him in consumer court.

Please advise.

you should file a complaint U/s 138 Negotiable instrument Act before illaqua magistrate if the payment is not made within stipulated period.

You Should file complaint u/s 200 cr.p.c for offence u/s 138 of N.I. Act before the jurisdictional magistrate.
