Cheque bounced

DEAR EXPERTS,

WE HAD GOT A CHEQUE FROM THE STATE GOVT. (U.P) IN LIEU OF DAMAGES OF CROPS DUE TO NATURAL PROCESS, WHEN SUBMITED THE SAID CHEQUE IN BANK IN ORDER TO ENCASH THE CHEQUE GOT BOUNCED DUE TO SUFFICIENT AMOUNT, NOW MY QUERY IS THAT CAN A CLAIM FOR THIS ACT AGINST THE GOVT. IF YES THEN PLEASE LET ME KNOW THE COMPLETE PROCESS

Sometimes Government cheques get bounced because of delay in allocation in Governent account under the Head.You may try presenting the cheque again after some time.

Pl. read proviso of Section 141 of NI Act "Where a person is nominated as a Director of a company by virtue of his holding any office or employment in the Central Government or State Government or a financial corporation owned or controlled by the Central Government or the State Government, as the case may be he shall not be liable for prosecution under this chapter.

What is the relevance of section 141 here? No one suggested that anyone is to be prosecuted. Further it is not a Goverment nominee in a company but the Government itself.

True Section 138 cannot be used here. He can present the cheque again. Still if he does not succeed he can go to the concerned Government office and inquire. It may be just red tape.
