Chargesheet and warrant

Hi,

We have filed a private complaint in the court and subsequently the police have registered an FIR last month.

Now the police have filed the chargesheet to the court.Howmany days will it take for the court to issue warrant and what happens after the warrant is issued ?

How can court issue warrant?

if police didnt arrest the accused during investigation. that means there is no need of custody

BTW, what is th complain all about , under IPC which section

Suggest you to obtain CS copy of your case first.

Court will issue summons against all accussed as mentioned in CS by concern police official.

Then CR.PC procedure continued as applicable in all cases.

After filing of the chargesheet the judicial magistrate will take cognizance on it then only the summon will be isused. If the magistrae does not take cognizance of direct for further investigation then in that case there is no question of issuing summon.
