Certain questions on Law

Hello Members,

How long will it take for a petty criminal case in a Learned Judicial Magistrate court to pronounce a verdict?

Once a charge sheet is framed what are the other causes for delay?

Can we use RTI Act to find out the status of a petty criminal suit in a Learned Judicial Magistrate court which is pending for more than 3years?

A public/commercial building is constructed in violation of Tamil Nadu District Municipalities Rules. The municipality filed a petty criminal suit against the offender. Under the Tamil Nadu District Municipality Act, 1920 (or in any court of law of our country) is there any bar to proceed with demolition or lock and seal the land and building (as per Tamil Nadu Town and Country Planning (Amendment) Act, 2008) when a case is filed against the offender by the Municipality under section 205(3), 317, 339, 340 and 313 is pending trial?

Thanks,

Dr. Nirmal

time  for conclusion of case can not be predicted.

if the case adjournment is being sought unnecessarily , and court is also adjourning the case unreasonably, a mandamus from the high court can be sought by a party for expeditious disposal.

RTI can not be used in respect of a court file.
