Cases u/s 498, & d.v.

Hello Experts,

Good Evening.  May I have your guidance to solve my problem please.  The details are as under:

Thrown by in-laws just after 5 months from marriage, living with mother-father for the last 3 years, application u/s 12 hma against me set aside by the court, getting intrim maintenance, no other case filed, having no income proof.    

Querries :

1. Should we file case of 498/D.V. ? If yes, then when ? 

2. How to call for the proof of income/employment from private companies ?
