Canteen food vouchers and tenants' liability

Compulsory canteen food vouchers are included in the monthly maintenance bill and are to be paid by the owners of all flats. The canteen is in the housing society and run by the builder. Maintenance bills are still being raised by builder as yet no handover given to the RWA.

Query:

Can the owners require their tenants to pay for food vouchers as maintenance? Their lease is silent on this, and the tenants not used/ consumed these food vouchers.

This seems to be a strange condition which is unknown, however the owners can object to this and refuse if it is not a condition in the sale deed.

Pls read que again. Question is not owner vs builder. Que is can owner make liab tenant and as part of monthly maintenance to pay?

The conditions not mentioned in the rental agreement is not enforceable.

Payment of food has to be made by consumer (tenant in instant case) and no one else can be held liable except (voluntary payment) as donation. 

However, is it a legal dispute / problem Mr. Rakesh Kumar, CACISA, which you have posted for  consideration and obligation of experts on this platform ??? Ridiculous.

Your resp shows you didnt rightly understood dispute.

Can the tenant be held liable by owner for food vouchers not consumed by anyone. Secondly, can it be charged or pass on as monthly maintenance by owner to tenant just because owner has to pau to builder whethrr he consumes or not?

The owner or the builder can not force the members of the chs or tenants either to buy or to pay for the canteen vouchers  if they object. Even if it is mentioned in any documents, it is not binding and can be considered as signed under duress. It is Ultra Vires.
