Can you transfer trademark ownership? - vakilsearch

transfer trademark ownership- The assignor, who is the owner of the trademark, has the right to sell, license, or transfer it just like any other asset or piece of property. The Trademark Assignment Agreement or Trademark Licensing may be used to transfer a trademark.

Quick Summary
Yes, you can transfer trademark ownership. The process involves an assignment agreement that clearly identifies the trademark, the current owner, the new owner, and the specific rights being transferred. It's crucial to record this change with the relevant trademark office to update the official register. Licensing is a different mechanism where the original owner retains ownership but grants permission for another party to use the mark under agreed terms.

Yes trademark ownership can be transferred but the assignment should cover more than simply changing the name of the owner and also assignment needs to identify the mark, the current and new owner, and the rights being transferred. The change should then be recorded with the relevant trademark office so the register reflects the new ownership. Licensing is different because the original owner keeps the trademark and only gives another party permission to use it under agreed terms.
