According to Section 4(1) of the Payment of Gratuity Act, 1971, gratuity is payable to an employee upon termination of employment after he or she has rendered continuous service for at least 5 years. Section 4(2) of the legislation states that an employer must pay a gratuity to an employee at the stipulated rates for each completed year of service or part thereof over six months.

if he is Haryana Govt employee then Payment of gratuuity act may not apply.
