Can we file discharge application in domestic violence act

Dear friends,

I need some help / views from all of your Seniors. 

Can we file discharge application unde CRPC-239 in Domestic Violene  Act . 

Has anyone had any Judgement to support Dischare in DV.

Please share it with me.

No. Procedure of DV Act as Summon Case. CRPC 239 is only applicable in warrant case. Wait and watch and enjoy trial.

So, what is the procedure to deletion of the name from the respondents’ list?

Is there is any procedure in law to make this ?

Is Court summons to each respondents?. I have also facing trial of DV and there is no need to attend the court in each date to all respondents.

can if file it u/s. 258 of CRPC.

is 258 of CRPC is applicable on the Discharge App.

or i file it with out citing any Section.

Dear Manoj - No Cr PC or CPC provision require in this . Please mention each points which u think help to delete the name of the defendant adn submit it to MM/Session Court.
