Can we file contempt if cat case judgement is not accepted by department not a

You may have to look for a suitable lawyer yourself and can choose someone from this forum or outside who may be up to your expectations.

The facts posted lacks clarity.

It is impossible that the Department would have, through a  speaking order, refused to implement the decision where you were the applicant.

It appears that the facts are different - You had sought implementation of a decision by the CAT in a similar case. And the CAT had given a direction to Department to consider your case in the light of the said decision through a speaking Order. If so, your option is in filing a fresh OA.

What is the OA No? Which Bench?

CAT gave direction to implement the Ernakulam case stating we are similarly placed.

However department now gave a speaking order stating we are not similarly placed as Ernakulam officerscwere Adhoc whereas we are regular employees. 

This is the irony. When Adhoc are eligible how can regular be not eligible.
