Can society charge extra maintainance for tenants?

I have taken a commercial property on lease and the society has started charging 10% extra on maintainance for tenants. They say law says that societies can charge 10% from tenants of flats and shops.


Is this true?

yes, as per the judgement of the Bombay High Court in 2007 the limit on non occupany charges has been limited to max. 10% on the service charges only i.e. Property taxes are excluded from calculation of 10% on the monthly maintenance charges.
