A elder sister filed a partition suit against his 3 younger brothers. Now the case is almost at the end. Now only one brother using that land for agriculture & other two brothers staying in the city & not coming to that village from many years & relationship between brothers also no good. That elder sister well settled in her husband village, she asked for the partition only to trouble her brothers.
They have 4 acres of land & have 9 RTC in different locations.
Question is that person who is doing agriculture can request court to leave her sister partition of land at any one side, instead of divide in all the RTC?
because from 22 years fighting is there between elder sister & the brother who using the land in the village. if that lady got property in all RTC, definitely every day quarrel will be there between them & she may trouble him. that person must do agriculture for his family maintainance. but for that lady no need that property. because she already well settled with her husband in the other village.
please someone answer for this query.
