Can release deed done in such situation

Hi All,

   We have a Property (Named XYZ) which was on my Mother's name (She expired in 2003). Now the legal heirs are 3 - Myself, My Dad, My Brother. We have internally discussed to divide the property into 3 parts equally between us.

 A seprate application has been filed in court for SUCESSION CERTIFICATE & the court is yet to give decision on that.

Now, my question is that - Can I get a release deed of my dad/brother for the particular share (which is decided to be given to me out of XYZ property). I am asking this question because -

=> As on today my demised mother is the owner. So, legally my brother/father are not owners but heirs of that property ?

Do comment your valueable suggestions.

As a legal heir they can relinquish their rights on the property and issue NOC for trnaferring the property in your name as a legal heir too.
