Can OC be legally issued by BMC for under construction buildings ?

A new phenomenon is being practiced and publicized by builders in Mumbai.

They entice buyers by mentioning that full OC is received for the project from BMC though buildings are only 40% ready just with basic RCC structure.

Is it legal? Please help.

How did BMC issue OC when the building was still incomplete ?

Challange it before appropriate authority / Court, it is invalid and illegal, if facts posted are true.
