Can i sell a disputed property

Hi, I filed a petition on my uncle who trespassed my land and built a structure. My uncle claims that, that piece of land belongs to him, since previous seller signed some documents before. 

That case is still in beginning stages. Now, since there is no stay on the property, can I withdraw the case and sell this property to someone else?

What will be the consequences there after?

What happens if I withdraw my petition and sell the land without the defendant's notice?

You can withdraw your case and just sell the land, otherwise also you can sell it since there is no stay or court restriction.
