Filing of affidavit is just a routine matter , most imp aspect is the deponet has to be cross examimed. If no cross the affadavit has no meaning.

The chief Affidavit can be filed in the absence of deponent but he has to appear for cross

But if the witness is unable to come to court, we can file petition for appointment of commissioner if petition allowed there is necessary to appear court
