Can a rwa force a member of family who is not the owner  to pay extra donations

 

May I request with Learned Lawyers is what is the rule  on maintenance charges for  individually owned property . Can a RWA force a member of family who is not the Owner  of the house to pay Extra Donations without informing the Owner ? 

Can a member be forced to pay additional charges ?  

How  are the monthly  charges for all independet house should be collected on the basis of per square feet.. please advise regarding this

The RWA cannot force a member of the family to pay donation or any kind of payment including maintenance other than owner that too only if there's any default.

If you are the victim you can take legal action as per law against the management of RWA.

No RWA can seek donation from its member(s). 

However, there is no question of asking donation from a non-member.

- No under the law, RWA cannot compel a non-owner family member to pay anything unless 
is a contarctual agreement. 
- If the non-owner family member has no liablity in the property, he/she cannot be compelled to 
pay.
- No donations or charges can be requested or forced to be paid.
- Owners remain ultimately liable unless the occupant has contractually assumed liability.

What kind of donations? 

How RWA is collecting "monthly charges"? What type of monthly charges?

True u are very perceptive

Past several years RWA sought extra funds toward developement of the sector & forced members to pay Rs 25000/ annualy in addition to Membership charge. (WITHOUT RECEIPT) 

I was paying this  amount  but two years back when I requested contact details of the owwner of empty land  to  repair my house from adajascent   land RWA DENIED TO PROVIDE CONTACT DETAILS . This emplty land next to my house was diverting water  into mine causing  immense damage to my house. 

I repetedly requested RWA to provide contact but no support infact turned violent upon which I stopped the annual donation. However I filed grievances with authority and Jansunwai portal  a notice was served  & PASTED to the owner . 

In short  since then RWA is  coercing my family member to pay this amount without providing receipt.
